1. Acceptance of Terms
By accessing and using the services of Orusa Tours & Travel (“we,” “our,” “us,” “the Company”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use our services.
2. Service Description
Orusa Tours & Travel provides travel planning, booking, and tour services within Kenya and internationally. Our services include but are not limited to:
- Tour package arrangements
- Travel itinerary planning
- Accommodation bookings
- Transportation arrangements
- Safari experiences
- Adventure activities
- Cultural tours
3. Booking and Payments
3.1 Reservations
- All bookings are subject to availability
- A booking is confirmed only after receipt of the required deposit
- Full payment must be received by the specified due date before travel
3.2 Payment Terms
- Deposits: 30% of the total tour cost required to confirm the booking
- Final payment: Due 45 days before departure
- Last-minute bookings (within 45 days): Full payment required at time of booking
- All prices are quoted in USD unless otherwise specified
3.3 Payment Methods
- We accept major credit cards, bank transfers, and other specified payment methods
- All bank charges and transaction fees are the responsibility of the client
4. Cancellation and Refund Policy
4.1 Cancellation by Client
- More than 60 days before departure: Full refund minus administrative fee
- 45-60 days: 70% refund of total tour cost
- 30-44 days: 50% refund of total tour cost
- 15-29 days: 25% refund of total tour cost
- Less than 15 days: No refund
4.2 Cancellation by Company
- Full refund if the tour is cancelled by Orusa Tours & Travel
- The company reserves the right to cancel tours due to insufficient participants
- Force majeure cancellations will be handled on a case-by-case basis
5. Travel Documentation
- Clients are responsible for obtaining all necessary travel documents
- Valid passport with minimum 6 months validity required
- Proper visas and permits must be obtained where necessary
- Vaccination requirements must be met as per destination requirements
6. Travel Insurance
- Comprehensive travel insurance is mandatory for all tours
- Insurance must cover medical emergencies, evacuation, and trip cancellation
- Proof of insurance must be provided prior to departure
- The company is not liable for any losses that would have been covered by insurance
7. Health and Safety
- Clients must disclose any medical conditions before booking
- The company reserves the right to decline service based on health concerns
- Clients must follow safety instructions provided by guides and staff
- Company not liable for injuries resulting from client negligence
8. Liability and Limitations
8.1 Company Liability
- The company maintains appropriate insurance and licenses
- Liability is limited to direct services provided by the Company
- No liability for third-party services or force majeure events
8.2 Third-Party Services
- The company acts as an agent for third-party providers
- No liability for actions, negligence, or failures of third-party providers
- Third-party terms and conditions may apply
9. Client Responsibilities
- Respect local customs and regulations
- Follow guide instructions and safety protocols
- Maintain appropriate behaviour and conduct
- Report any issues promptly to Company representatives
10. Photography and Marketing
- The company reserves right to use photos taken during tours for marketing
- Clients may opt out of photo usage in writing
- Client photos shared with the company may be used for promotional purposes
11. Privacy
- Client information is protected as per the Privacy Policy
- Data collection and usage are outlined in a separate Privacy Policy
- Marketing communications are subject to client consent
12. Complaints and Dispute Resolution
- Complaints must be reported immediately to allow for resolution
- Written complaints are accepted up to 30 days post-tour
- Disputes subject to Kenyan law and jurisdiction
- Mediation required before legal proceedings
13. Force Majeure
Company not liable for failures or delays due to:
- Natural disasters
- Political unrest
- Public health emergencies
- Other circumstances beyond reasonable control
14. Changes to Terms
- Company reserves the right to modify these Terms
- Changes effective upon posting to the website
- Continued use constitutes acceptance of changes
